HM Revenue and Customs (HMRC) 2008-09 employer annual returns year end filing deadlines have passed but you can still avoid late-filing penalties.

The deadline for P14s and P35s was 19 May. However, there is an Extra Statutiory Concession that delays the use of the late filing penalty to the 26th May.

HMRC state that a penalty will be levied if they haven't received and accepted a full return by 23.59 on Tuesday 26 May where a firm files online or when the post is opened on Wednesday 27 May where a firm files by paper.

Strangely, HMRC also confirm that even, though the deadline has passed, businesses with less than 50 employees filing electronically will still receive their £75 tax-free payment.
